2. PRODUCTS SUBJECT TO THE ORDER

3. SUBJECT OF THE AGREEMENT

This agreement covers the license terms and subscription conditions for the use of the purchased software product on a properly configured computer.

4. SCOPE OF THE LICENSE

4.1 GENERAL PROVISIONS
- The usage license covers the rights to install, run, use, display, store, and backup the software on a computer.
- CUSTOMER cannot lend or rent the software to third parties.
- All other copyright and ownership rights not covered by this non-exclusive right remain with TUTICAD.
- Rights and obligations arising from this agreement cannot be transferred to third parties.

4.2 SINGLE COMPUTER USE
- CUSTOMER cannot install the software on two or more computers simultaneously. Active internet connection is required for license activation and operation.

4.3 MULTI-USER USE
- CUSTOMER can purchase additional user rights to install and use the TutiCad Software on multiple computers.

5. LIMITATION OF LIABILITY

- TUTICAD does not guarantee that its software products will be flawless, error-free, and meet all user needs.
- TUTICAD takes daily backups of the information stored in the Cloud environment.
- For local use, database backup and security are the responsibility of the customer.

6. SOFTWARE COPYRIGHTS

- Software and documentation are protected by Law No. 5846 on Intellectual and Artistic Works.

7. CONDITIONS FOR DELIVERY OF SOFTWARE PRODUCTS

- CUSTOMER agrees to receive the software products licensed under this agreement via email.

8. INSTALLATION FILE, WRITTEN DOCUMENT (DOCUMENTATION)

- The copyrights of the installation file and documentation belong to TUTICAD.

9. VERSION/RELEASE CHANGE, MODULE AND MAINTENANCE

- TUTICAD reserves the right to make changes to its software and documentation.

10. CANCELLATION AND RETURN CONDITIONS

- CUSTOMER has the right to return the software within 14 days without giving any reason. The refund for the returned software will be made within 14 days from the acceptance of the return request.
- Subscription cancellations can be made at any time before the end of the subscription period. However, no refund will be given for the period of the canceled subscription.

11. SUBSCRIPTION CONDITIONS

- Customer will make payments through a monthly subscription system. If the monthly payment cannot be received, the account will be frozen after 5 days.
- Customer will pay the subscription fees by credit card. If payment is not made on the due date, the account will be frozen after 5 days and access will not be possible until payment is made.
- Annual support payment is mandatory for indefinite cloud users. Support payment is not mandatory for customers using the monthly payment option.

12. TRAINING AND SUPPORT

- One hour of free training will be provided on first use. Extra support and special additions will be quoted separately.
- Support will not be provided by phone unless it is urgent (especially outside working hours). You can always reach us via email and WhatsApp, and we will get back to you at the earliest opportunity.

13. PRIVACY AND DATA SECURITY

13.1 Definition and Scope of Confidential Information
- Confidential Information refers to all commercial secrets and/or proprietary information of the parties.
- Confidential Information can be shared verbally, in writing, or visually.

13.2 Conditions of Use of Confidential Information
- Confidential Information will be used only for the intended purpose.
- Confidential Information will not be disclosed to third parties other than the relevant personnel.

13.3 Information Not Covered by Confidential Information
- Public information is not covered by Confidential Information.

13.4 Ownership of Confidential Information
- Confidential Information remains the property of the disclosing party.

14. TERMINATION OF THE AGREEMENT DUE TO DISSOLUTION CONDITION

- If the CUSTOMER fails to pay the license fee or pays it incompletely.
- If the CUSTOMER violates TUTICAD's copyrights.

15. OTHER PROVISIONS

- In disputes arising from this agreement, the local enforcement offices and courts of the parties making the agreement are authorized. Turkish law applies to disputes.
- This agreement is deemed to have been accepted by the CUSTOMER.
